InventHelp® Client Makes a Splash with Pool Invention for SwimWays

One hot, summer day, while watching kids play dive games in her backyard pool, Merry Jane Kusz, an InventHelp client, found her inventive spirit take hold. After much thought, she decided on the features of a dive game that would provide kids hours of fun. Her invention, the Aqua Ball dive game, was born.

The object of the game is to retrieve and disarm the Aqua Ball, a plastic device that resembles a ticking time bomb. The built-in timer provides the players a preset amount of time to jump into the pool, find the Aqua Ball, bring it to the surface and turn off the timer, i.e. "diffusing the bomb."

Kusz believed pool owners would enjoy the Aqua Ball as a pool toy, so in August of 2004, she took her dive-and search game to a Wisconsin InventHelp sales office where she purchased submission services and asked for a referral to a patent attorney. She received a patent in 2007.

InventHelp client's Submergency invention was licensed by SwimWaysOne of the companies InventHelp submitted the Aqua Ball concept to was SwimWays Corporation, a well- known manufacturer of pool products. SwimWays did not express an interest in the Aqua Ball at that time. Some time later SwimWays independently developed a similar pool game called Submergency™. Believing that SwimWays had incorporated aspects of her Aqua Ball game into Submergency, Kusz called Intromark Inc., InventHelp's sister licensing company, for assistance.

This story has a happy ending, as Intromark was able to work out an agreement whereby Kusz's 703 patent was licensed to SwimWays. The SwimWays Submergency product is currently being sold in major retailers like Target, Toys R Us, Walmart, Sears, Boscov's, and online retailers like Amazon.com. According to Kusz, she is happy she chose InventHelp. "I appreciate all that your company has done. You do indeed stand behind your customers."

We are pleased to report that InventHelp's services have resulted in a financial gain for Ms. Kusz.


From 2009-2011, we signed Submission Agreements with 4607 clients. As a result of our services, 116 clients have received license agreements for their products, and 26 clients have received more money than they paid us for these services.
